As part of the 49 newly introduced implementing regulations to Law No. 11 of 2020 on Job Creation (“Job Creation Law”), the government has issued Regulation of Government No. 43 of 2021 on the Settlement of Incompatibilities Relating to Spatial Planning, Forest Areas, Licenses and/or Land Rights (“Regulation 43/2021”), to accommodate the one of the revisions on spatial planning matters which introduced under the Job Creation Law.
In essence, Regulation 43/2021 establishes a set of procedural settlement guidelines for cases where incompatibilities emerge between spatial planning, forest areas, licenses, concessions, land rights and/or the right-to-manage in relation to the following areas: 1) Regional boundaries; 2) Forest areas; 3) Spatial Planning (Rencana Tata Ruang Wilayah – “RTRW”); 4) Licenses; 5) Concessions; 6) Land rights and/or the right-to-manage; 7) Coastlines; 8) Marine Spatial Planning (Rencana Tata Ruang Laut “RTRL”), Zoning Plans for Certain Nationally Strategic Areas (Rencana Zonasi Kawasan Strategis Nasional Tertentu – “RZ KSNT”), Interregional Zoning Plans (Rencana Zonasi Kawasan Kawasan Antarwilayah “RZ KAW”) and/or Coastal Zones and Small Island Zoning Plans (Rencana Zonasi Wilayah Pesisir dan Pulau-Pulau Kecil – “RZWP-3-K”); and/or 9) Licenses relating to activities involving the utilization of marine areas.
